PARTICIPANT RELEASE and WAIVER
Tournament Name: 9th Annual Links to Freedom Veterans Day Benefit
Tournament Location: Winchester Country Club, 1300 Senseny Rd, Winchester, VA 22602
Tournament Date: November 6-7, 2026
In consideration of being permitted to participate in the above-referenced charity golf tournament ("Tournament"), I, the undersigned participant ("Participant"), hereby acknowledge, agree, and represent as follows:
- I acknowledge that participation in the Tournament involves inherent risks, including but not limited to risks of personal injury, property damage, illness, or death that may result from my own actions, the actions of other participants, weather conditions, course conditions, golf cart operation, errant golf balls, and other hazards associated with the game of golf and Tournament activities. I knowingly and voluntarily assume all such risks associated with my participation.
- I hereby release, waive, discharge, and covenant not to sue Links to Freedom, a Virginia Nonstock Corporation ("L2F"), the above referenced Golf Course ("Golf Course"), and their respective owners, operators, officers, directors, members, managers, employees, agents, volunteers, representatives, successors, and assigns (collectively, the "Released Parties") from any and all liability, claims, demands, actions, causes of action, costs, expenses, damages, or losses of any kind or nature whatsoever, whether known or unknown, arising out of or in any way related to my participation in the Tournament, including but not limited to claims for personal injury, wrongful death, property damage, or economic loss, regardless of whether such claims are based on negligence, breach of contract, or any other legal theory. This release and waiver is intended to be as broad as permitted under the laws of the State where the Tournament is being held. If any portion of this release is held invalid, the remainder shall continue in full legal force and effect.
- I agree that I will not commence or prosecute any lawsuit, action, or other proceeding against any of the Released Parties based upon any claim released herein arising out of and related to my participation in the Tournament.
- I hereby grant L2F, its agents, employees, licensees, and assigns, the irrevocable and unrestricted right and permission to photograph, videotape, audio record, or otherwise capture my name, image, voice, likeness, statements, and performance (collectively, "Media") during the Tournament and related activities.
- I hereby grant L2F the perpetual, worldwide, royalty-free, non-exclusive right and license to use, reproduce, edit, modify, publish, display, distribute, broadcast, and otherwise exploit the Media in any and all media formats now known or hereafter devised, including but not limited to (a) promotional and marketing materials for L2F; (b) social media platforms and websites; (c) print publications, advertisements, brochures, and newsletters; (d) television, radio, and online broadcasts; and (e) fundraising and charitable solicitation materials.
- I acknowledge and agree that I will not receive any compensation, royalty, or other payment for the use of the Media, and that L2F has no obligation to use the Media.
- I hereby waive any right to inspect or approve the finished product or any written copy that may be used in connection with the Media, and I waive any right to royalties or other compensation arising from or related to the use of the Media. I release and discharge the Released Parties from any and all claims, demands, or causes of action that I may have or hereafter acquire arising out of or in connection with the use of the Media.
- I represent and warrant that I am at least eighteen (18) years of age, have no medical conditions that would prevent my safe participation in the Tournament, and have obtained all necessary medical clearances for participation in physical activity. I authorize the Released Parties to obtain or provide emergency medical treatment for me if necessary, and I agree to be financially responsible for any costs incurred as a result of such treatment.
- This Release and Waiver constitutes the entire agreement between the Participant and the Released Parties concerning the subject matter hereof and supersedes all prior agreements, understandings, and representations. If any provision of this Release and Waiver is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- This Release and Waiver shall be governed by and construed in accordance with the laws of the state where the Tournament is held, without regard to its conflict of laws principles. Any legal action arising out of or relating to this Release and Waiver shall be brought exclusively in the courts of said state.
- I acknowledge that I have carefully read this Release and Waiver, fully understand its contents, and voluntarily sign it of my own free will. I understand that this is a release of liability and a contract between myself and the Released Parties, and I sign it with the intent to be legally bound.
